Fitness International, LLC, a leader in the fitness industry for over 40 years and operating across 25 states, has issued a statement regarding the recent complaint filed by the Federal Trade Commission (FTC).

“We are disappointed that the FTC has chosen to pursue this complaint. The allegations lack merit, and the statute cited by the FTC—the Restore Online Shoppers’ Confidence Act (ROSCA)—was established nearly 15 years ago to address online retail transactions specifically. It does not mandate any particular cancellation method and has never been applied to the health club sector. We are confident in our position and believe we will prevail in court.”
It’s important to highlight that all personal training subscriptions and most memberships are purchased in person at our club locations. However, we took proactive steps by introducing an online cancellation option for all members, irrespective of how they enrolled, 18 months prior to the FTC’s forthcoming ‘Click-to-Cancel’ rule. We voluntarily enabled members to cancel their subscriptions online with just a few clicks, well ahead of regulatory timelines. Despite the recent invalidation of the FTC’s ‘Click-to-Cancel’ rule by a federal appellate court, we have chosen to maintain our online cancellation service, ensuring our members have an easy option to manage their subscriptions. Furthermore, members can always choose to cancel in person at any club or by mailing their requests.
Our organization is dedicated to complying with all state regulations regarding health club membership cancellations and strives to provide at least the cancellation options mandated by each state. Over the years, we have made significant enhancements to our enrollment and cancellation procedures.
